Claim 11 is comparable in scope to claim 12, while claim 19 most nearly resembles claim 18 in scope. The appealed claims were rejected under 35 U.
The examiner's description of the Bobb reference is generally adequate for our purposes; thus we quote it at some length:. Figure 1 of Bobb shows a block diagram of the magnetic recording and reproducing apparatus.

Each of claims 12 and 13 further requires that each of the heads have its own amplifier. Clearly, the Bobb reference is deficient in disclosing that claimed combination. The solicitor recognizes that Bobb did not consider the possible use of separate recording and playback heads, but relies upon a statement of the appellant during prosecution to the effect that tape recorders having separate recording and playback heads are conventional in the art.
He argues that appellant has compromised here two concepts, retaining separate playback and recording heads, while using the same "filter-amplifier" circuit in the playback mode. He rhetorically questions whether that possibility would have been obvious to one of ordinary skill in the art, arguing, of course, in the affirmative. However, merely to state that such tape recorders are known to the art does not make that claimed combination obvious to one of ordinary skill in the art under the requirements of 35 U.
Under that statutory test, we must evaluate the claimed invention as a whole. Doing so, we find the differences between the claimed subject matter and the prior art of record as evidenced by the Bobb patent and appellant's statements, are such that that claimed subject matter cannot be said to be obvious. In addition to the specific requirements of the claims relating to the tape recorder, each of the appealed claims sets forth means clauses in the claims to denote the activity of the combination during either the playback or recording mode.
Claim 11, for example, requires "means operative when the tape recorder is set for recording to connect the signal supplying means to feed its signal through the filter-amplifying circuit and the recording head amplifier to the recording head while making the feedback circuit ineffective. Similar limitations are found in the remaining claims, claims 12 and 18 being reproduced above with the corresponding limitations emphasized.
For the same reasons, the rejection may not stand on this art of record, even when taken with appellant's statements. A word of explanation is in order relative to the use of certain of appellant's statements during prosecution. The board referred to the fact that appellant had agreed that tape recorders having separate recording and playback heads with respective preamplifiers are "old" or "well known" in the art.
Appellant's brief before the Board of Appeals, where similar statements appear, was not part of the printed record before the court. Upon inquiry from the court during oral argument, the solicitor moved to correct diminution of the record by the addition of that paper.
A subsequent paper filed by the solicitor limited the request to certain portions of the brief. Appellant opposed. We think the requested portions of that paper bear upon the state of the prior art, at least to the extent of what appellant admits is "conventional. We thus grant the motion of the solicitor and make it clear that the specified portions of appellant's brief have been considered in reaching our decision.

The self-described dashing duo of Fritz Heller of Fritz Frequencies and Tony Chipelo of Electra Fidelity joined forces again for this show, and they seemed to be far too happy about it. Just look at these guys [in the shots below]. Nobody who hates his job ever looks like that. That might be because putting a Fritz room together is one of the easier jobs in the business. Fritz makes some floorstanders, but he prefers speakers that are small enough to lift without machinery.

Anyhow, google Fritz speakers for many trade show reports and links to my 40 reviews of many of my models including this model below which I got the Editors Choice award from Part Time Audiophile for my Carrera model below.

It is little secret that I am a tube fan, and ampsandsound is one of my favorite tube amp companies Why? The only thing that kept this from being my opening review for HiFiAudio. Guru was the question of speakers. Our original choice of speaker did not pan out, they simply did not respond, at all and for that I am thankful. So when Justin Weber founder of ampsandsound suggested that we use the system that he planned to display at T. Show was rescheduled, though no new dates have been announced at this time. As I have mentioned before, perhaps often, cable affects the sound of a system every bit as much as any other component other than the speakers, so in any proper system review, cables need to be a factor. Things outside the signal path, like power cables, can be considered a tweak and can be upgraded later, interconnects and speaker cables are integral to the aggregate sonic profile of the system.

LOG IN. I posted this on a different forum but thought I would copy my post here on Audiogon since Fritz sometimes sells his speakers here. Post: I have owned my Fritz Carrera BE speakers for a while so I thought I would share my opinions to others who may be considering a speaker purchase. First off, I have to say that Fritz is one of the nicest and most humble guys I have met in the audio manufacturer world. Even if his speakers were not as superb as they are, you would feel good about supporting Fritz because he is one of the "good" guys. I became aware of the Fritz speakers after reading a review on 10 Audio.
