DISQUALIFICATION MATTER - COURT CAN'T GIVE DIRECTIONS TO SPEAKER: SPEAKER TO HC

The Speaker of Goa Legislative Assembly has filed an affidavit before the High Court in a petition filed by Congress leader Girish Chodankar pleading to direct the respondent Speaker to decide his disqualification petition against 8 defected Congress MLAs within 90 days.

The Speaker in the affidavit has contended that a court cannot give direction to the Speaker as it is a constitutional post. But, unconvinced by the contention of the Speaker, the High Court observed that the court cannot be quiet if the Speaker arbitrarily sleeps over the petition for 10 years.

A special bench of the High Court on Friday heard the petition filed by Congress leader Girish Chodankar pleading to direct the respondent Speaker of Goa Legislative Assembly to decide his disqualification petition against 8 defected Congress MLAs within 90 days.

During the hearing, the Speaker filed his affidavit in which he contended that proceedings in 2 disqualification petitions similar to Girish Chodankar's petitions have already began and Girish Chodankar's petition will also be heard in some days. The Speaker in the affidavit has also raised the issue of the power of the High Court and has contended that the High Court can not give direction to the Speaker as it is a constitutional post.
